1. Introduction

Welcome to USAWTV.com (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and all professional photography, videography, and media production services (“Services”) offered by USAWTV.com in the United States of America.

By hiring us, making a payment, or accessing our website, you agree to comply with these Terms. If you do not agree, please discontinue use of our Services.


2. Services

We provide freelance photography, videography, editing, drone filming, and creative production for personal, commercial, and corporate clients throughout the U.S.

Service details (deliverables, pricing, schedule) are always defined in a written Quotation or Service Agreement (the “Agreement”) sent to the client before work begins.


3. Booking and Payment

  • Bookings are confirmed only after both parties agree in writing and a deposit is received.
     
  • Unless otherwise stated, a non-refundable deposit of 30% is required to reserve the date.
     
  • Final payment is due upon project completion or before finatheir  file delivery.
     
  • Payments may be made via bank transfer, Zelle, PayPal, or another agreed method.
     
  • Late payments may incur a 5% monthly late fee or the maximum amount permitted by law.
     

4. Cancellation and Rescheduling

By Client:

  • Cancellations made more than 14 days before the scheduled shoot: deposit is non-refundable but may be applied to a future session within 3 months.
     
  • Cancellations within 14 days or no-shows: the full fee may still apply.
     

By USAWTV.com:

  • We may cancel or reschedule in case of illness, equipment failure, unsafe conditions, or force-majeure events.
     
  • If we cancel, any deposit will be refunded in full.
     

5. Deliverables and Turnaround

  • Edited digital photographs and/or videos are typically delivered within 2 – 6 weeks, depending on project scope.
     
  • Delivery is via digital download, flash drive, or online gallery.
     
  • RAW files are not included unless explicitly purchased.
     
  • Once final deliverables are accepted, USAWTV.com is not responsible for archiving or storage beyond 30 days.
     

6. Copyright and Usage Rights

  • All images and videos remain the copyrighted property of USAWTV.com under U.S. Copyright Law (Title 17 U.S.C.).
     
  • Upon full payment, the client receives a non-exclusive, limited-use license for personal or agreed commercial purposes.
     
  • The client may not resell, alter, or sublicense any media without written consent.
     
  • USAWTV.com retains the right to use selected works for portfolio, promotional, or editorial purposes, unless the client specifically requests privacy in writing before the shoot.
     

7. Model Release and Permissions

  • By hiring USAWTV.com, you grant permission to photograph or film the agreed subjects and locations.
     
  • Clients are responsible for obtaining any necessary model releases, property releases, or permits required for filming.
     
  • For minors, parental or guardian consent is mandatory.
     

8. Liability

  • We will exercise reasonable care and skill during every project.
     
  • Our liability for any claim shall not exceed the total fees paid for the affected Service.
     
  • USAWTV.com shall not be liable for indirect or consequential losses, including loss of profits, emotional distress, or missed opportunities.
     
  • We are not responsible for delays caused by equipment malfunction, weather, power failure, or other circumstances beyond our control.
     

9. Client Cooperation

  • Clients must provide accurate details, access permissions, and ensure that scheduled shoots can proceed safely.
     
  • Late arrivals or unprepared settings may shorten the session or require additional fees.
     
  • Clients may not edit, retouch, or filter our delivered work in a way that misrepresents artistic intent without prior consent.
     

10. Drone and Aerial Services

When drone filming is part of the project, all operations comply with FAA Part 107 regulations.
The client must ensure the filming location allows drone operation under local and federal rules.


11. Privacy and Data Protection

We value your privacy. Any personal information shared with USAWTV.com (email, phone, photos, addresses) is used solely for business and communication purposes.
We do not sell or share personal data with third parties without consent.

12. Force Majeure

Neither party is liable for delays or failure to perform obligations caused by circumstances beyond reasonable control — including but not limited to natural disasters, strikes, illness, accidents, or government restrictions.


13. Independent Contractor Status

USAWTV.com operates as an independent contractor, not as an employee or agent of any client.
Nothing in these Terms creates an employer-employee, joint venture, or partnership relationship.


14. Indemnification

The Client agrees to indemnify and hold harmless USAWTV.com, its owners, and contractors from any claims, damages, or expenses arising from the Client’s misuse of the deliverables or failure to obtain necessary permissions.


15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, United States.
Any disputes shall be resolved in the competent courts of Los Angeles County, California, unless both parties agree otherwise in writing.


16. Revisions and Updates

We may revise these Terms periodically. Updates will be posted on this page with a new effective date. Continued use of our Services after updates constitutes acceptance of the revised Terms.
