USAWTV.com provides freelance photography, videography, and related creative services (“Services”) in Belgium and internationally. Details of each assignment will be confirmed in a written quotation (“Quote”).

• A signed Quote and deposit confirm your booking.
   
• Payments are accepted via bank transfer, PayPal, or approved methods.
   
• Late payments may incur interest or delay delivery.
   

• Cancellation more than 14 days prior → deposit may be refunded.
   
• Cancellation within 14 days → fee may apply.
   
• Rescheduling is subject to our availability.
   

Edited images and/or videos will be delivered in the format agreed upon in your Quote, typically within 4 weeks unless otherwise stated.

All photographs and videos remain the intellectual property of USAWTV.com.
Upon full payment, you receive a non-exclusive, non-transferable licence to use the media for personal or agreed commercial purposes.
Promotional use by USAWTV.com (portfolio, social media, website) is allowed unless you request otherwise in writing.

You are responsible for providing accurate event details, ensuring all permissions (venue, model releases), and cooperating during shoots.

Our liability is limited to the total amount paid for the Services. We are not liable for indirect losses, delays caused by force majeure, or client negligence.

USAWTV.com reserves the right to cancel or postpone a project due to illness, safety issues, or other unforeseen events, with deposits refunded where applicable.

These Terms are governed by Belgian law. Disputes will be handled by the courts of Antwerp, Belgium.

Welcome to USAWTV.com (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website and freelance photography and videography services (“Services”) offered across the Vlaanderen (Flanders) Region of Belgium, including Antwerp, Boom, Brussels outskirts, and surrounding municipalities.

By accessing our website or hiring us for Services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, please refrain from using our website or booking our Services.

USAWTV.com provides professional photography, videography, drone filming, editing, post-production, and related creative services for personal, commercial, and event purposes.
All Services are delivered according to the written quotation (“Quote”) or agreement provided to the Client before the project begins.

• A booking is confirmed once the Client accepts the Quote in writing (email confirmation is sufficient) and pays the required deposit as specified in the Quote.
   
• Verbal agreements or tentative holds are not binding until confirmed in writing.
   
• USAWTV.com reserves the right to decline or postpone any booking that conflicts with existing schedules, weather conditions, or safety requirements.
   

• Unless otherwise stated in the Quote, a 30% non-refundable deposit is required to secure the booking.
   
• The remaining balance must be paid upon completion of the Services or before delivery of final images/videos.
   
• Payments are accepted via bank transfer, PayPal, or other approved methods listed in the Quote.
   
• Late payments may incur an administrative fee or interest in accordance with Belgian law.
   

By the Client:

• Cancellation more than 14 days before the shoot: deposit is non-refundable but transferable to a new date (within 3 months, subject to availability).
   
• Cancellation within 14 days or failure to attend: the full balance may become due.
   

By USAWTV.com:

• In case of illness, accidents, equipment failure, or other unforeseen circumstances, we may reschedule the session or refund any deposit.
   
• We are not liable for further compensation in such cases, except to return amounts paid for Services not performed.
   

• Deliverables (digital images, edited videos, or other media) will be supplied within the timeframe agreed in the Quote (typically 2–6 weeks, depending on project complexity).
   
• All files are delivered in digital format unless otherwise stated.
   
• Original RAW files remain the property of USAWTV.com and are not included unless explicitly agreed in writing.
   
• Once final files are delivered and approved, no further liability shall exist regarding storage, backup, or loss of files.
   

• All photographs, videos, and other creative works produced by USAWTV.com are protected under Belgian and EU copyright law (Auteurswet) and remain the intellectual property of USAWTV.com unless otherwise agreed.
   
• Upon full payment, the Client receives a non-exclusive, non-transferable licence to use the images/videos solely for the purposes stated in the Quote.
   
• The Client may not sell, alter, or sublicense the materials without written permission.
   
• USAWTV.com reserves the right to use any image or video for portfolio display, website, social media, exhibitions, or marketing, unless the Client requests in writing to restrict publication (e.g., for privacy or confidentiality reasons).
   

• The Client is responsible for obtaining all necessary permissions, permits, and releases for locations, models, or third-party appearances.
   
• The Client agrees to indemnify USAWTV.com against any claims arising from failure to obtain such permissions.
   
• For minors (under 16), parental or guardian consent is mandatory before any photography or filming takes place.
   

• USAWTV.com will exercise due care in providing Services but shall not be liable for indirect, incidental, or consequential losses, including but not limited to loss of profit, reputation, or data.
   
• In any event, our total liability shall not exceed the total amount paid by the Client for the specific project.
   
• USAWTV.com is not responsible for delays or cancellations caused by force majeure events (e.g., natural disasters, illness, weather, transport failure, or government restrictions).
   
• All equipment used is insured, and we comply with standard professional safety measures in the Flanders region.
   

• The Client agrees to cooperate and provide all information, schedules, and instructions necessary for the smooth execution of the project.
   
• Any delays or issues caused by the Client (e.g., late arrival, unprepared venues) may result in additional fees or shortened coverage time.
   
• The Client agrees not to interfere with the photographer/videographer during the session.
   

We respect the privacy of all clients and subjects photographed or filmed.
All personal data is handled in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).
Clients can request access, correction, or deletion of their data at any time by emailing usawtv@gmail.com.

When drone or aerial footage is requested, operations will be conducted in compliance with EU Regulation 2019/947 and Belgian CAA (BCAA) guidelines for drone use within the Vlaanderen area.
Clients must ensure that aerial filming is permitted at the shoot location.

Neither party shall be liable for any failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to fire, flood, strikes, war, pandemic, or equipment malfunction.

These Terms shall be governed by and interpreted in accordance with Belgian law.
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Courts of Antwerp, Belgium, unless mandatory law requires otherwise.

USAWTV.com reserves the right to update or amend these Terms at any time without prior notice. The latest version will always be posted on our website and indicated by an updated “Effective Date.” Continued use of our Services after such changes constitutes acceptance of the revised Terms.
